GENERAL TERMS OF USE

These Terms of Use regulate the interaction between INVESTPRO 975 LTD., a company registered in the Republic of Bulgaria , with headquarters in Sofia, Strelbishte district, ul. haidushka gora n 112, UIC 207923985, which manages the website glampingnest.net, hereinafter referred to as the "Platform", and all users of the platform, including guests and hosts.

 

These Terms and Conditions are a binding legal agreement between you and glampingnest.com, which governs your right to use the website, referred to as the "Platform". When used in these Terms, “glampingnest.com”, “we”, “us” or “our” refers to the legal entity behind glampingnest.com, identified above, with whom you are contracting.

 

glampingnest.net   allows users to post, offer, search and book services. Users who post and offer services, are "Hosts" and members who search, book, or use services are "Guests." Hosts offer accommodation (“Accommodation”), activities, excursions and events (“Experiences”), as well as a variety of travel and other services (collectively, “Host Services” and each Host Services offering a “Listing”). As a provider of The glampingnest.com platform, INVESTPRO 975 LTD does not own, control, offer or manage any listings, hosting services or travel services. glampingnest.com is not a party to the contracts concluded directly between hosts and guests, nor is it a real estate broker. , travel agency, insurer or organizer or retailer of travel packages under Directive (EU) 2015/2302. glampingnest.com does not act as an agent in any capacity for any Member, except as set forth in the Payment Terms (“Payments and Fees”).

 

We maintain other terms and policies that supplement these Terms, such as our Privacy Policy, which describes our collection and use of personal data, and our Terms of payment, which govern all payment services provided to members by the payment entities of glampingnest.com ("Payments and Fees") .

 

Welcome to www.glampingnest.net (“Website”). By accessing or using our platform, you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, you may not use the Website.

 

I. DEFINITIONS

 

1.1. Platform – The online marketplace provided by www.glampingnest.net for listing, booking, and managing glamping accommodations., operated by INVESTPRO 975 LTD.

1.2. User – Any natural or legal person who uses the platform, including guests and hosts.

1.3. Guest – User who have reservations for Accommodations or Experiences through the Platform.

1.4. Host – A User who offers Accommodations or Experiences through the Platform.

1.5. Accommodation – A property offered for short-term rental through the Platform.

1.6. Experience – A service or activity offered by hosts (e.g. excursions, cooking classes, tours).

1.7. Booking – A confirmed inquiry for an Accommodation or Experience made by a Guest through the Platform.

 

 

 

II. REGISTRATION AND ACCESS

2.1. Each user must create a profile on the platform, providing current and accurate information.
 2.2. The platform reserves the right to refuse registration or deactivate profiles in case of violations.
 2.3. Only adults (over 18 years of age) may register and use the platform's services.

III. SEARCH AND RESERVE

 

3.1. Accommodation Reservations

3.1.1. Guests can search for properties and services through the platform using filters by dates, location, prices and other criteria.

3.1.2. All search results are based on availability and the selected criteria.

3.1.3. To make a reservation, you need to have a registered account on the platform.

3.1.4. The reservation is considered confirmed after payment is made through the platform.

3.1.5. When making a reservation, the guest is obliged to comply with all conditions mentioned in the host's listing.

3.1.6. When booking a listing, you agree to pay all fees for your reservation, including the price of the listing, applicable fees such as glampingnest.com service fee, taxes and all other items identified at the time of payment.

3.1.7. If you choose to pay in a currency that differs from the currency set by the Host for their listing, the price shown to you is based on a currency exchange rate set by us.

3.1.8. When you receive a booking confirmation, a contract for Host Services (“Booking”) is formed directly between you and the Host. In addition to these Terms, you will be subject to and responsible for complying with all terms of the Booking, including, but not limited to, cancellation policies and any other rules, standards, policies or requirements set out in the Listing or at the time of check-out. It is your responsibility to read and understand these rules, standards, policies and requirements before booking a listing.

3.1.9. If you stay after check-out, the Host has the right to force you to leave in a manner permitted by applicable law, including by imposing reasonable penalties for presser. You cannot exceed the maximum number of guests allowed.

 

3.2. Reservations for Experiences

3.2.1. Experiences can only be booked subject to availability and according to the stated conditions.

3.2.2. A reservation for an Experience or other Host Service entitles you to participate in, attend, or use that Experience or Host Service.

3.2.3. The details of each experience or service are described by the host and the guest should familiarize themselves with them before confirming the reservation. .

3.2.3. Guests provide accurate information about themselves when necessary for the safety of the experience.

 

IV . EMAILS AND SMS

 

You will receive messages from us for every request for a new reservation, confirmation for such, or cancellation of a reservation. For all other communications allowed by the platform, including these, you will also receive an email.  

 

V. PRICES, PAYMENTS AND FEES

 

5.1. All prices on the platform include applicable taxes unless otherwise stated.

5.2. The Platform charges a service fee, which is clearly stated before finalizing the reservation. All applicable fees are disclosed to Hosts before posting a listing and to Guests before making a reservation. Unless otherwise stated on the glampingnest.com platform, service fees are non-refundable.

5.3. All payments are made through the platform using the payment methods provided.

5.4. Guests are responsible for paying the total amount of the reservation, including taxes.

5.5. Payments are made through secure payment methods provided by the platform.

5.6. The Platform facilitates transactions between Guests and Hosts. As part of this service, the Platform shall deduct the agreed commission from the total booking amount and remit the remaining balance to the Host. The payment to the Host shall be processed within fifteen (15) business days following the Guest’s check-in date, subject to the successful receipt of funds from the Guest.

5.7 In the event of a cancellation or chargeback, the Platform shall deduct the agreed commission from the total refunded or chargeback amount and remit the remaining balance to the Host within fifteen (15) business days from the date of cancellation or chargeback resolution. If the chargeback or refund results in insufficient funds to cover the agreed commission, the Host shall be liable for the outstanding amount, which may be deducted from future payouts or otherwise recovered by the Platform.

5.8 The Host is solely responsible for determining, reporting, and remitting any applicable taxes, including but not limited to VAT, local tourism taxes, or other levies, as required by law. The Platform shall not be responsible for any tax obligations of the Host.

5.9 The Platform shall not be liable for payment delays caused by factors beyond its control, including but not limited to banking issues, payment processor failures, or incorrect payment details provided by the Host. In case of a dispute regarding payments, the Host must notify the Platform in writing within thirty (30) days of the disputed transaction.

 

VI. CANCELLATIONS AND CHANGES

 

6.1. Cancellations by guests

6.1.1. The Terms Cancellation policies are set by the host for each listing and are clearly stated in the listing

6.1.2. If a guest cancels a reservation within the free cancellation period, the amount will be refunded in full.

 

6.2. Cancellations by hosts

6.2 .1. If the host cancels the reservationtation, the platform will provide a refund to the guest.

6.2.2. Hosts who frequently cancel reservations may be penalized or removed from the platform.

 

6.3. Changes to reservations

6.3.1. Changes to reservations are made by mutual agreement between the guest and the host.

6.3.2. Fees for changing a booking are subject to the terms and conditions stated in the listing.

 

 

 

VII. RIGHTS AND OBLIGATIONS OF THE PARTIES

 

7.1. Hosts:

 

7.1.2.  As a host, glampingnest.net offers you the right to use the platform in accordance with these Terms to share your accommodation, experience or other host service with our vibrant community of guests – and earn money doing so. It’s easy to create a Listing and you control how you host – set the price, availability and rules for each Listing.

7.1.3. When you accept a booking request or receive a booking confirmation via the glampingnest.com platform, you enter into a contract directly with the guest and are responsible for providing the host service according to the terms and price stated in your Listing. You also agree to pay applicable fees such as the glampingnest.com service fee (and applicable guest taxes) for each reservation.

7.1.4. glampingnest.net does not direct or control your hosting service and you understand that you have complete discretion as to whether and when to provide hosting services and at what price and under what terms to offer them.

7.1.5. Your listing must include complete and accurate information about your hosting service, your price, other fees such as cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your guests or listing.

7.1.6. You are responsible for obtaining appropriate insurance for your hosting services

7.1.7. Hosts guarantee that the property or services correspond to the description published on the platform. Hosts are responsible for their actions and omissions, as well as for keeping the property information (including calendar availability) and content (such as photos) up-to-date and accurate at all times.

7.1.8. Hosts are responsible for the regular maintenance and suitability of the property for use.

7.1.9. Hosts must welcome guests under the agreed conditions and within the specified deadlines.

7.1.10. Comply with all requirements of applicable law, including declaring income and paying due taxes.

7.1.11. Hosts guarantee that they have all necessary permits and licenses. Experience organization guidelines.

7.1.12. Hosts must ensure the safety of guests during the experience.

7.1.13. Payment processing services for [account holder term, for example, drivers or sellers] on [platform name] are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to [this agreement / these terms / and so on] or continuing to operate as a host on the Platform you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of the Platform enabling payment processing services through Stripe, you agree to provide the Platform accurate and complete information about you and your business, and you authorize the Platform to share it and transaction information related to your use of the payment processing services provided by Stripe.

 

 

7.2. Guests:

7.2.1. Guests are required to comply with the host's rules published in the listing and to use the property or services with care and in accordance with the agreed terms and conditions and for their intended purpose, without causing damage.

7.2.2. Guests are responsible for any damage caused and may be required to cover the costs of repair or replacement.

7.2.3. Guests must not violate public order or the laws of the country.

7.2.4. Guests are responsible for their own actions and omissions and are also responsible for the actions and omissions of anyone they invite to join  the Accommodation, or any Experience or other Host Service.

7.2.5. If you are booking for an additional guest who is a minor, or if you are bringing a minor to the Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for supervising such minor.

7.2.6. Guests are responsible for informing the Host of any medical or physical conditions or other circumstances that may affect the ability to participate in, attend, or use the Experience or Host Service.

7.2.7. Guests have the opportunity to write a review after each service. The review must be accurate and may not contain discriminatory, offensive, defamatory, or other language that violates these terms or applicable law. Reviews are not checked by glampingnest.com for accuracy and may be incorrect or misleading.

 

7.3. The Platform:

7.3.1. Provides a technological platform for connecting Guests and Hosts.

7.3.2. Is not responsible for the quality or condition of the properties or services offered, nor for the actions of users.

7.3.3. The Platform and all Content are provided without any warranty and glampingnest.net disclaims any warranties, express or implied. For example:

7.3.4. The Platform acts only as a marketplace and is not responsible for the condition of listed accommodations, actions of Hosts or Guests, or any damages incurred.

  • glampingnest.net does not guarantee the existence, behavior, effectiveness, safety, quality, legality or suitability of any guest, host, host service, listing or third party;
  • glampingnest.net does not guarantee the operation or lack of interruption of the Platform.
  • 7.3.5 Any disputes between Guests and Hosts should be resolved directly between the parties.

 

VIII. TAX LIABILITIES

 

8.1. Each host is responsible for declaring their income from the platform and paying the taxes due.

8.2. The Platform is not responsible for the tax obligations of hosts or guests.

8.3. Hosts must provide tax information upon request by the relevant authorities.

 

 

IX. SECURITY AND CONFIDENTIALITY

9.1. The Platform processes users' personal data in accordance with the Privacy Policy.

9.2. All payments are processed through secure payment systems.

 

 

 

 

X. PLATFORM RULES

 

10.1. All users must behave respectfully and not abuse the features of the platform.

  • Do not scrape, hack, reverse engineer, compromise or degrade the platform.
  • Do not use bots, scrapers or other automated means to access or collect data from the  platform.
  • Do not hack, damage or attempt to circumvent any security or technological measures used to protect the Platform.
  • Do not take any action that could damage or adversely affect the performance or proper functioning of the platform.

10.2. Users must comply with ethical standards and not publish misleading information.

 

  • Do not lie, misrepresent anything or anyone, or impersonate someone else.
  • Be polite and respectful when communicating or interacting with others.
  • Do not attempt to avoid enforcing these Terms, Policies, and Standards,
  • Do not create  duplicate accounts or ads.

 

10.2. It is prohibited to use the platform for illegal activities or violation of the law.

10.3. Users must report any violations or misconduct.

 

XI. GOVERNING LAW AND DISPUTE RESOLUTION

 

11.1. These terms and conditions are governed by the legislation of the Republic of Bulgaria.

11.2. All disputes shall be resolved through negotiations, and if impossible – by the competent court.

 

XII. FORCE MAJEURE

glampingnest.net is not liable for any delay or failure to perform as a result of unusual or unforeseeable circumstances beyond its reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, actions of civil or military authorities, fire, floods, accidents, pandemics, epidemics or diseases, strikes or shortages of transportation facilities, fuel, energy, labor or materials.


Cancellation Policies 


Flexible cancellation policy Full Refund: Guests may cancel up to 7 days prior to check-in to receive a full refund, including all cleaning fees. Partial refund: If canceled between 7 days and 24 hours before check-in, 50% of the reservation amount will be refunded. No Refunds: Cancellations made less than 24 hours prior to check-in will not result in a refund. 


 Moderate cancellation policy Full Refund: Guests may cancel up to 14 days prior to check-in to receive a full refund including all cleaning fees. Partial refund: If canceled between 14 and 7 days before check-in, 50% of the reservation amount will be refunded. No Refunds: Cancellations made less than 7 days prior to check-in will not result in a refund. 


 Strict cancellation policy Full Refund: Guests may cancel up to 30 days prior to check-in to receive a full refund, including all cleaning fees. Partial refund: If canceled between 30 and 14 days before check-in, 50% of the reservation amount will be refunded. No Refunds: Cancellations made less than 14 days prior to check-in will not result in a refund.
